Bankruptcy and Your Marriage

Married individuals often think that if they file for Bankruptcy, they must do so jointly with their spouse.  This is wrong.

Many times, the great majority of the debt is in the name of only one spouse.  In this situation, filing individually would probably be the best choice.

However, if each spouse is liable for the debt, then filing jointly would likely be the best alternative.
Occasionally, I will meet with only spouse because the other spouse can't stand the notion of Bankruptcy.  this is not a concern. A spouse can file bankruptcy individually.
